Terms of Service

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of age and to terminate accounts that do not meet eligibility requirements.

To use certain features you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You are solely responsible for all activity under your account and for maintaining the confidentiality of your login credentials. You must notify us immediately at support@beviralapp.com if you suspect unauthorized use of your account.

BeViral provides AI-powered analysis of short-form video content. The Service includes: - Video upload and automated processing (speech-to-text, visual analysis, trend detection). - Generation of a virality score, predicted engagement metrics, and content recommendations. - Storage of analysis reports in your account. The AI-generated results are informational estimates only. They do not constitute professional advice and are not guarantees of actual social-media performance.

(a) Ownership. You retain all intellectual property rights in the videos and other content you upload ("User Content"). (b) License to Us. By uploading User Content you grant BeViral a limited, non-exclusive, royalty-free, worldwide license to process, analyze, and temporarily store your User Content solely for the purpose of providing and improving the Service. This license terminates when you delete the User Content or your account. (c) Representations. You represent and warrant that: (i) you own or have all necessary rights and permissions to upload the User Content; (ii) the User Content does not infringe or violate any third-party intellectual property, privacy, or other rights; and (iii) the User Content complies with all applicable laws.

You agree not to: - Upload content that is unlawful, defamatory, obscene, harassing, or that exploits minors. - Use the Service to infringe any third-party copyright, trademark, or other intellectual property right. - Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App or its AI models. - Circumvent, disable, or interfere with any security or access-control features of the Service. - Use automated scripts, bots, or scrapers to access the Service. - Resell, sublicense, or commercially exploit the Service or any data obtained through it without our prior written consent. - Introduce viruses, malware, or any other harmful code. - Impersonate any person or entity, or misrepresent your affiliation.

All rights, title, and interest in the App — including its design, code, AI models, algorithms, graphics, trademarks, and all related intellectual property — are and remain the exclusive property of BeViral or its licensors. These Terms do not grant you any right to use our trademarks, trade names, or logos without prior written consent.

(a) Free and Paid Plans. The App may offer both free features and paid subscription plans with additional functionality. (b) Billing. All paid subscriptions are processed and billed by Apple through the App Store. By subscribing you also agree to Apple's terms of service and payment policies. (c) Auto-Renewal. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. (d) Cancellation. You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period; no partial refunds are provided. (e) Refunds. Refund requests are handled exclusively by Apple in accordance with their refund policy. We do not process payments or issue refunds directly. (f) Price Changes. We may change subscription prices upon reasonable notice. New prices take effect at the start of the next billing cycle after the change.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) the AI-generated results will be accurate, reliable, or complete; or (c) any defects will be corrected. Virality predictions are statistical estimates produced by automated systems and should not be relied upon as the sole basis for any content or business decision.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEVIRAL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (US $100), WHICHEVER IS GREATER. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless BeViral and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, fraudulent or abusive activity, or extended inactivity. Upon termination: (a) your license to use the App immediately ceases; (b) we may delete your account data in accordance with our Privacy Policy; (c) Sections 4(c), 6, 8, 9, 10, 12, 13, and 14 survive termination. You may terminate your account at any time by deleting it through the App settings or by contacting support@beviralapp.com.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict-of-laws provisions. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the competent courts in the Company's jurisdiction. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in any court of competent jurisdiction.

The following additional terms apply when you download the App from the Apple App Store: (a) These Terms are between you and BeViral, not Apple. Apple is not responsible for the App or its content. (b) Apple has no obligation to provide maintenance or support for the App. (c) In the event of any failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. (d) Apple is not responsible for addressing any claims relating to the App or your possession and use of the App. (e) In the event of any third-party claim that the App infringes that third party's intellectual property rights, BeViral, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim. (f) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. (g) You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist-supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms in the App and updating the "Effective date" above. If a change materially reduces your rights, we will also notify you via the App or email at least 30 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and delete your account.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy and any subscription terms presented at the time of purchase, constitute the entire agreement between you and BeViral regarding the Service and supersede all prior agreements, understandings, and communications.
